Is this really free?
Yes. Bankruptcy Legal Aid Foundation provides pro bono Chapter 7 bankruptcy legal assistance at no cost to qualifying applicants. Services are provided through charitable support and limited resources. Debtors are only required to pay for mandatory credit reports. Most debtors will qualify for bankruptcy filing fee waivers and class fee waivers.
Do I automatically qualify if I meet the basic requirements?
No. Meeting basic eligibility criteria does not guarantee acceptance. All applications are subject to legal review, case suitability, and availability of resources.
What type of bankruptcy cases do you handle?
BLAF provides assistance only with consumer Chapter 7 bankruptcy cases. We do not handle Chapter 13 cases, business bankruptcies, or complex matters.
Do you represent me in court?
Yes. If your case is accepted, BLAF will provide legal representation through the Chapter 7 process, including the filing of documents and representation related to the case. Representation begins only after written confirmation of acceptance.
Do you handle emergency or same-day filings?
No. BLAF does not provide emergency or same-day bankruptcy filings. All cases must go through the intake and review process.
Can I apply if I am self-employed or have a business?
Generally, no. Applicants with current self-employment income or active business operations are not eligible for pro bono services. Some self employed Applicants engaged in Lyft, Uber, etc. may qualify.
Can I apply if I own a home or other real estate?
Generally, no. Applicants who own real estate, including a home, condominium, or land, are generally not eligible for pro bono assistance. Some exceptions apply.
What if I do not qualify?
If your case is not accepted, you may be referred to other legal resources or self-help options where available. BLAF cannot guarantee referrals.
Does making a donation increase my chances of being accepted?
No. Donations do not affect eligibility, review, or acceptance decisions.
Does submitting an intake form create an attorney–client relationship?
No. Submitting an intake form or inquiry does not create an attorney–client relationship. Representation begins only after written confirmation of acceptance.
How long does the process take?
Timelines vary depending on case complexity, completeness of information provided, and availability of resources. BLAF cannot guarantee processing times.
What information will I need to provide?
Applicants should be prepared to provide complete and accurate information about income, assets, debts, and financial circumstances. All information must be truthful and verifiable.
Is my information kept confidential?
Yes. BLAF respects privacy and handles information in accordance with applicable confidentiality and privacy laws.
