We help individuals and families who otherwise lack meaningful access to bankruptcy representation. The following criteria guide preliminary screening; final acceptance is subject to review.
Applicants must have lived in California for the majority of the last 180 days.
Applicants generally must not own real estate (including a home, condominium, or land) and must have little or no non-exempt assets under applicable bankruptcy exemption laws. Some exceptions may apply.
Applicants must meet all of the following:
You are experiencing ongoing financial hardship (such as job loss, disability/medical issues, divorce, or fixed income), and your finanical situation is unlikely to improve in the foreseeable future.
Pro bono services are reserved for applicants who lack meaningful access to other bankruptcy legal assistance. Eligibility is determined after review of available resources.
Meeting these criteria does not guarantee representation. All applications are subject to review, discretion, and availability. Click here for more details.
For many individuals and families, these events trigger wage garnishments, bank levies, collection lawsuits, and the constant threat of losing basic stability. Federal bankruptcy law exists to provide lawful relief—but access to that relief is not equal.
Although Chapter 7 bankruptcy can stop collection activity and provide a fresh start, the process is complex, technical, and unforgiving. Many people cannot afford a private attorney, and filing without counsel is often unrealistic due to limited access to technology, language barriers, health challenges, or the sheer complexity of the legal system.
Self-representation is not a meaningful option for many low-income Californians.
Without legal representation, eligible individuals remain trapped in cycles of debt that threaten housing, employment, and family stability.
Bankruptcy Legal Aid Foundation exists to close that gap.
We provide free, full legal representation in Chapter 7 bankruptcy matters to low-income and indigent individuals who otherwise lack access to counsel. Our work is rooted in a simple principle: access to justice should not depend on income.
We believe bankruptcy relief should be administered fairly, lawfully, and with dignity—by qualified attorneys, not left to chance.
We do not provide advice alone. We do not hand out forms and send people on their way.
We provide complete legal representation, including:
This level of representation is essential to ensuring that bankruptcy law functions as Congress intended—for everyone.
Our services are focused on individuals and families facing genuine financial hardship and limited resources. We work in partnership with community organizations and service providers to reach those most at risk of economic instability.
By providing access to legal counsel, we help preserve housing, protect wages, and restore stability to households across California.
Bankruptcy relief is a legal right—not a privilege reserved for those who can afford representation.
Bankruptcy Legal Aid Foundation is committed to ensuring that right is accessible, meaningful, and fairly administered.
We help people file for bankruptcy relief under the United States Bankruptcy Code.
